Terms & Conditions

All holidays operated by Singletrack Safari (“the Company”) are sold to the clients (“the Clients” or “you”) subject to the following conditions:

1) Confirmation of Booking

A contract shall exist between you and the Company when a completed booking form and deposit (plus insurance premiums where appropriate) is received and your holiday confirmation is dispatched. The deposit required in order to confirm your booking will be equal 20% of the total price for your group. If you are making a booking less than 6 weeks before the start date of your holiday full payment will be required at the time of booking. Details of exactly what is and is not included in your contract with the Company are shown within the Company website. You should be familiar with the details of this before booking.

2) Payment of Balance

Payment of final balance must be received 6 weeks prior to the commencement date of the holiday. Failure to pay on time may result in cancellation charges. If you are making a booking less than 6 weeks before the start date of your holiday full payment will be required at the time of booking.

3) Cancellation Charges

Cancellation notice is required in writing and charges may be made as listed below:

Over 6 weeks                  deposit and insurance premiums

4-6 weeks                  20% of holiday cost

3-4 weeks                  40% of holiday cost

2-3 weeks                  60% of holiday cost

1-2 weeks                  70% of holiday cost

Under 1 week                  100% of holiday cost

To transfer to another holiday you must notify us at least at least 6 weeks prior to departure, pay a £75 fee, plus any increase in holiday cost. The Company reserves the right to refuse any request to transfer to another holiday.

4) Free Transfer Service

This applies only to transfers to and from the accommodation relevant to the following locations; Bristol Temple Meads Station (Wild West and South Wales Holidays), Newcastle Airport (Scottish Stanes Holiday), Birmingham International Airport and Station (North Wales Explorer Holiday), Edinburgh Waverley Station and Edinburgh Airport (Wild Scotland Holiday), Malaga Airport (Spanish Trail Tapas Holiday), Geneva Airport (Ultimate Alps Holiday), Barcelona Airport (Andorran Altitude Holiday). Free transfers are only available as detailed in clause 5.

5) Hours of Operation of Free Transfer Service

Transfers are only available during the hours specified for the holiday on our website.  If other clients are arriving on the same day it will be necessary to wait for their arrival before the transfer departs for its destination. Additional transfers outside the stated hours may be arranged on certain holidays for an additional fee.

6) Singletrack Safari Guides

The Company’s guides are not high mountain guides, but possess extensive local knowledge, and for safety reasons will only guide clients on defined trails. You must abide by the authority of your guide. If they believe that your behaviour presents any risk to the safety of the group you may be asked to leave the group. You will not be entitled to any refund.

7) Dangerous Sports

Clients ride entirely at their own risk. Clients must make their own decisions regarding their abilities, however our guides can provide advice if requested. The Company wishes to make it clear that Singletrack Safari holidays are not suitable for beginners. Upon booking clients are required to agree that Mountain Biking is a potentially hazardous activity, and as such accept that the Company cannot be held liable for client safety whilst riding. Furthermore clients are required to state at the time of booking if they are aware of any relevant medical conditions which could put their health at risk whilst Mountain Biking, and that they must consult a GP or specialist in order to gain medical certification that they are in good health to undertake our activities.

8) Singletrack Safari Vehicles

Transport during the holiday in the Company’s vehicles is a free service (unless specified) and may be withdrawn due to circumstances beyond our control. We will however try to provide an alternative service should this occur. Clients travel in the Company’s vehicles at their own risk.

9) Insurance

All clients must have proof of appropriate and adequate active sports insurance cover, and must wear a helmet whilst riding at all times. If no proof of insurance is available, or no helmet is worn, the Company reserves the right to refuse to guide the clients concerned. You must present proof of your insurance cover to the Company’s representatives upon arrival.

10) Cancellation by the Company

The Company will only cancel your holiday if a) it is forced to do so by unusual or unforeseeable circumstances, such as war or unrest or b) it is forced to do so as a result of flight cancellations or c) the minimum number of bookings required to operate the tour has not been reached (see clause 11). If the Company cancels your holiday you will be offered an alternative. If this is not acceptable the Company will refund monies received in respect of the cost of the tour. We will not be liable for any other expenses which you have incurred as a result of your booking.

11) Minimum numbers

If the minimum number of clients for a holiday (3) is not reached by 6 weeks before departure, as a last resort, we reserve the right to cancel the holiday and/or make significant modifications to the holiday and/or make an extra charge of up to £100 to each person booked on the tour. You will be given these options by the Company should this clause be invoked.

12) Other Activities

The Company acts as an agent only in respect of all activities, whether or not included in the tour price, which are organised and operated by any other company. Your contract will be directly with the activity provider and subject to their booking conditions.

13) Surcharges

In extraordinary circumstances we reserve the right to impose surcharges up to 6 weeks prior to departure due to unfavourable exchange rate movements, increased transport costs or as a result of any government action. You will only be charged an amount above 2% of the basic holiday cost, and if the charge exceeds 10% of the basic holiday cost you may cancel your booking by providing the Company with written notification within 7 days of your being notified of the level of the surcharge. This cancellation will be governed by the same alternative holiday and refund terms as clause 10 above.

14) Holiday changes

This type of holiday will always be subject to changes in itinerary and it is a fundamental condition of your booking that you accept this. You must accept that the web site descriptions are to give you a guide as to what to expect from your holiday but that there will still be considerable flexibility when on the holiday. You will not be refunded for any services not utilised such as the Free Transfer Service.

15) Complaints

If you have a complaint about your holiday you should communicate it to the Company representatives so that remedial action can be taken if possible. In any event you must notify the Company of any complaint, in writing, within 14 days of the completion of your holiday.

16) Company responsibilities

The Company accepts no responsibility for any damage or loss arising from a failure to carry out the contract, or in the process of carrying out the contract, as a result of a) actions by the Client or b) unusual and unforeseeable circumstances beyond the control of the Company or c) any event which the Company, even with all due care, could not foresee or forestall or d) the theft of or damage to bicycles or other equipment or injury to the Client which occur as result of cycling on or off a road, or while in transit in any vehicle or trailer, or at any other time during the holiday. Where the Company is found to be liable for any damages, howsoever arising, these damages shall be limited to the price paid for the holiday.

16) Information provided by the Company

Any information provided by the Company or its representatives is done so in good faith but without any liability on the part of the Company or its representatives. The Client remains responsible for finding out any necessary information, such as vaccinations, visa requirements, baggage allowances, etc.

17)  Cycle Hire.

a) All hired bicycles remain the property of the Company or other rental companies, and shall not be sold, hired or loaned out by the Client.

b) If a bicycle is hired via another rental provider hire is subject to their booking conditions.
b) The Client acknowledges that the bicycle hired is in good condition and undertakes to return the bicycle and any accessories in that same condition, or to make a payment to the Company, immediately on demand, sufficient to return the bicycle to that condition.
c) The Company shall not be liable for any damage or loss arising from the Clients use of the equipment. The Client shall indemnify the Company against any claim howsoever arising as a result of the Client’s use of the bicycle during the period of hire.
d) In the event that the bicycle and/or any accessories are lost or stolen the Client shall indemnify the Company for the costs of replacing those items. Should the equipment subsequently be returned in a satisfactory condition these monies will be repaid.
e) The Client will ensure that the bicycle is adequately secured when not in use and will immediately notify the Company or one of it’s representatives in the event of any theft, loss, breakdown or other occurrence relating to the bicycle or associated accessories.
f) All monies due in relation to the hire of bicycles will be added to the tour cost and will be payable in accordance with the Company’s booking conditions.

YOUR FINANCIAL PROTECTION

All monies paid by the Client under this contract are held in a Trust Account, controlled by a trustee acting on your behalf. These monies are not released to the Company until your holiday has been completed or, in the event of a cancellation, the contract has been completed in accordance with the booking conditions. This fully complies with UK law, as defined in The Package Travel, Package Holidays and Package Tour Regulations 1992, and is for the protection of you, the consumer. The Company does not provide flights or travel to the start of the holiday, other than the Free Transfer Service, and as such does is not required to be ATOL bonded.
